ARTICLE 1: Purpose

The purpose of these “Terms and Conditions of Use” is to provide a legal framework for the use of the websites of Eau de Vie s.r.l. (www.eaudevie.be, www.phytostep.be, www.toilettes-seches.be) and their services.

This contract is entered into between:

Eau de Vie s.r.l., as referred to in Article 2, hereinafter referred to as “the Publisher” or “Eau de Vie”,

et

Any individual or legal entity wishing to access the websites and their services, hereinafter referred to as “the User.”

All Users must agree to the Terms of Use, and by accessing the websites, they are deemed to have accepted these terms.

ARTICLE 2: Legal Notice

Eau de Vie s.r.l. is registered in Belgium under company number 0736.995.904, with its registered office located at Rue de Sart 64, 1490 Court-Saint-Etienne, Belgium.

The company is represented by Michèle Everaert and Jérémie Furniere.

ARTICLE 3: Access to Services

The Eau de Vie websites are referred to throughout this document as “the site.”

Users of the site have access to the following services:

  • Viewing the home page and various non-binding commercial information pages.
  • Product catalogs, with the option to place a non-binding order online.
  • A list of events related to Eau de Vie’s business or closely related to its field of activity.
  • A blog featuring various articles on topics related to Eau de Vie’s activities and the environment.
  • Comments on blog posts.
  • Features for creating a login ID, which is required to place orders.
  • A user portal that allows you to view orders, invoices, and various messages exchanged with Eau de Vie.

Any User with internet access can access the site for free from anywhere. The costs incurred by the User to access the site (internet connection, computer equipment, etc.) are not the responsibility of the Publisher.

The following services are available to Users only if they are members of the site (i.e., if they are logged in using their login credentials):

  • User Portal
  • Completing an Order

The website and its various services may be interrupted or suspended by the Publisher, particularly for maintenance purposes, without any obligation to provide advance notice or justification.

ARTICLE 4: User Liability

The User is responsible for any risks associated with the use of their login ID and password. 

The User’s password must remain confidential. The Publisher assumes no liability in the event that the password is disclosed.

The User assumes full responsibility for the use they make of the information and content on the site.

Any use of the service by the User that directly or indirectly results in damage to the site shall give rise to liability for repair costs or compensation.

The site allows members to post comments on blog posts.

The member agrees to post comments that are respectful of others and comply with the law, and accepts that such posts may be moderated or rejected by the Publisher without the need to provide an explanation. 

By posting content on the website, the User grants the publisher a non-exclusive, royalty-free right to display, reproduce, adapt, modify, publish, and distribute the content, either directly or through an authorized third party.

However, the Publisher agrees to give credit to the member if their publication is used.

ARTICLE 5: Publisher’s Liability

The Publisher shall not be held liable for any server or network malfunctions.

Similarly, the website cannot be held liable in cases of force majeure or due to unforeseeable and insurmountable actions by a third party.

The publisher is committed to taking all necessary measures to ensure the security and confidentiality of data. However, the publisher does not guarantee absolute security.

The Publisher reserves the right not to guarantee the reliability of the sources, although the information published on the site is deemed reliable.

ARTICLE 6: Intellectual Property

The content of this website (logos, text, graphics, videos, etc.) is protected by copyright under the Intellectual Property Code.

The User must obtain permission from the website publisher before reproducing, copying, or publishing any of this content.

These may be used by users for personal purposes; any commercial use is prohibited.

The User is solely responsible for any content they post online and agrees not to infringe upon the rights of any third party.

The website publisher reserves the right to moderate or remove content posted by users at any time and at its sole discretion, without providing a reason.

ARTICLE 7: Personal Data

Users must provide personal information in order to register on the site. 

The user’s email address may be used by the website to send various types of information and to manage the account.

The publisher guarantees the protection of users’ privacy in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the processing of personal data.

Under these regulations, the User has the right to access, correct, delete, and object to the processing of their personal data. The User may exercise this right by:

  • Their personal account on the website;
  • A contact form;
  • By email to info@eaudevie.be;
  • By mail to the Eau de Vie headquarters.

ARTICLE 8: Hyperlinks

The Publisher is not responsible for the websites linked to via hyperlinks on this site, as the Publisher has no control over these links.

A third party may link to a page on the site without the publisher’s express permission.

ARTICLE 9: Changes to the Terms and Conditions of Use

Eau de Vie reserves the right to modify the terms of these Terms of Use at any time and without notice.

ARTICLE 10: Term of the Contract

This agreement is entered into for an indefinite term. The agreement becomes effective for the User as of the date the service is first used.

ARTICLE 11: Governing Law and Jurisdiction

This contract is governed by Belgian law. 

In the event of a dispute between the User and the Publisher that cannot be resolved amicably, the courts of Nivelles shall have jurisdiction to settle the matter.
